Between September 24 and November 11 of this year, Ford filed nine mass lawsuits against more than 22,000 alleged file-swappers, each accused of sharing pornographic films with titles like <em>Teen Babysitters</em> and<em>Teen Anal Nightmare 2</em> and <em>Batman XXX: A Porn Parody</em>. Ford's initial lawsuits were releatively small, but he had enough confidence in his method by late October that he began filing against 7,000 and then 9,000 individuals at once.</div><div style="margin-bottom: 1.308em;">The judge overseeing these cases has had enough. Admiral Zumalt had given the command to use the defoliant while he was commander of Navy operations in Vietnam. Comments to this post suggested that there is an underlying problem in the way U.S. bankruptcy law treats student loan debt. She noted that the dominant explanation for discharge is “utilitarian”—holding that discharge promotes the overall good of society by encouraging individuals burdened by debt to engage in productive activity that they would otherwise forgo, since it would only benefit their creditors. Professor Hurd also pointed out two problems with this rationale: it allows people who may be culpable in incurring debt to escape responsibility, and it imposes losses on individual creditors who may not be able to afford them.</span></div><div style="margin-bottom: 10px; margin-top: 10px;"><span class="Apple-style-span" style="color: red;">The discussion following Professor Hurd’s presentation noted that U.S. bankruptcy law can be seen as mitigating these problems with utilitarianism. Some exceptions to discharge—e.g., for fraud or intentional injury—punish wrongful conduct in incurring debt. Others—e.g., for domestic support obligations—assure payment to creditors who may be in particular need. Priority of payment in bankruptcy similarly protects needy creditors. These considerations certainly help rationalize the U.S. bankruptcy system.</span></div><div style="margin-bottom: 10px; margin-top: 10px;"><span class="Apple-style-span" style="color: red;">The treatment of student loans, however, can’t be explained using this modified-utilitarian rationale. Student loans are generally incurred in good faith; indeed, they are encouraged as wise investments. And providers of student loans are not in particular need of repayment; they can easily spread their risks either to other student borrowers (through higher fees and interest) or to society at large (through government subsidies). Moreover, if it were thought that repayment of student loans was necessary for the lenders, some sort of priority, even if not a requirement of full payment in Chapter 13, would be expected. But there is no such priority—which makes the treatment of this debt punitive, despite the absence of wrongful conduct by the debtor.</span></div><div style="margin-bottom: 10px; margin-top: 10px;"><span class="Apple-style-span" style="color: red;">As originally enacted, the 1978 Bankruptcy Code provided that student loans could be discharged either if five years had passed from the time payment was first due or if the debtor provided for repayment during a three-to-five year Chapter 13 plan. This provision could be supported by the sort of “needs-based” rationale that underlies the means test: an intuition that while students might not be able to repay their loans immediately after graduation, they would likely be able to do so a few years later. Those struggling with major depression know for a fact that their lives will not and cannot get any better. For those made supine by this despair, antidepressant medication can be a literal life saver. Rather than elevating mood, these drugs put a floor underneath one’s mood so the whirlpool is shut off and the experience of an endless psychic descent ceases. With dysthymia, a person can still function after a fashion. However, life’s colors are faded. It’s more difficult to enjoy pursuits that had, not long ago, brought pleasure. We withdraw from our closest relationships. Paradoxically, I found myself coming home and drinking more. I love the taste of good vodka, and indulged that taste every evening. I say paradoxically because, as we know, alcohol is a quintessential depressant. However, I’ll also admit that I enjoyed the buzz before I drifted off to sleep. I wasn’t eating very well and found myself filling up this dark hole that was pulsating in my core with my favorite foods. (Try putting some salsa on Triscuit crackers, covering them with cheddar cheese and “nuking” the concoction in the microwave for three minutes. My mouth waters as I write this.) I saw myself dealing with people who had grown apart in their most intimate relationships, overwhelmed by grief, betrayal and (most definitely) fear. They were then dropped into a process in which they were being assaulted by sworn statements made by their spouses and forced to respond in kind. Litigated family law, I have come to believe, is a preposterous exercise. By the time a marriage ruptures, two people who had formerly been intimate have arrived at the end of a long path marked by thousands of interpersonal and intrapersonal events which are both momentous and staggeringly trivial when measured against their impact. These people then ask another human being, often someone who has no training or interest in either psychology or family law, to make momentous decisions for them decisions based on scant information (20 pages of a sworn statement and another 5 minutes of a lawyer making a pitch). In trial, decisions can rest on the strength of a two-hour appearance on the witness stand. That’s not my word, but it’s how my lack of interest in day-to-day household activities was labeled (not that I ever evinced much interest in this sphere of life). According to the Mayo Clinic, Co-Q-10 is manufactured naturally by the body, and low levels can, among other things, impact heart health. The vodka has been jettisoned. However, "nothingness" has been treated as a serious subject worthy of research for a very long time. In philosophy, to avoid linguistic traps over the meaning of "nothing", a phrase such as <i>not-being</i> is often employed to unambiguously make clear what is being discussed.</span></h3><h4 style="color: white; font: normal normal bold 22px/normal Arial, Tahoma, Helvetica, FreeSans, sans-serif; margin-bottom: 0px; margin-left: 0px; margin-right: 0px; margin-top: 0px; position: relative;"><span style="font-size: x-small;"><span class="mw-headline" id="Parmenides">Parmenides</span></span></h4>One of the earliest western philosophers to consider nothing as a concept was Parmenides (5th century BC) who was a Greek philosopher of the monist school. He argued that "nothing" cannot exist by the following line of reasoning. To speak of a thing, one has to speak of a thing that exists. Since we can speak of a thing in the past, it must still exist (in some sense) now and from this concludes that there is no such thing as change. As a corollary, there can be no such things as <i>coming-into-being</i>, <i>passing-out-of-being</i> or <i>not-being</i>.<sup class="reference" id="cite_ref-4"><a href="http://en.wikipedia.org/wiki/Nothing#cite_note-4" style="color: #727272; text-decoration: none;"><span></span><span></span></a></sup><br />
Despite the fact of existence stubbornly refuting Parmenides' conclusion, he was taken seriously by other philosophers, influencing, for instance, Socrates and Plato.<sup class="reference" id="cite_ref-5"><a href="http://en.wikipedia.org/wiki/Nothing#cite_note-5" style="color: #727272; text-decoration: none;"><span></span><span></span></a></sup> Aristotle too, gives Parmenides serious consideration but concludes; "Although these opinions seem to follow logically in a dialectical discussion, yet to believe them seems next door to madness when one considers the facts."<sup class="reference" id="cite_ref-6"><a href="http://en.wikipedia.org/wiki/Nothing#cite_note-6" style="color: #727272; text-decoration: none;"><span></span><span></span></a></sup><br />
<h4 style="color: white; font: normal normal bold 22px/normal Arial, Tahoma, Helvetica, FreeSans, sans-serif; margin-bottom: 0px; margin-left: 0px; margin-right: 0px; margin-top: 0px; position: relative;"><span style="font-size: x-small;"><span class="mw-headline" id="Leucippus">Leucippus</span></span></h4>Leucippus (early 5th century BC), one of the atomists, along with other philosophers of his time, made attempts to reconcile this with the everyday observation of motion and change. He accepted the monist position that there could be no motion without a void. The void is the opposite of being, it is <i>not-being</i>. On the other hand, a thing that exists is an absolute plenum and there can be no motion in a plenum because it is completely full. But there is not one monolithic plenum, existence consists of a multiplicity of plenums. These are the invisibly small atoms of the atomists theory, later expanded more fully by Democritus (circa 460 BC - 370 BC). They are a necessary part of the theory in order to allow the void to exist between them. In this scenario macroscopic objects can <i>come-into-being</i> move through space and pass into <i>not-being</i> by means of the coming together and moving apart of their constituent atoms. The void must exist in order to allow this to happen or else the frozen world of Parmenides must be accepted.<br />
Bertrand Russell points out that this does not exactly defeat the argument of Parmenides, but rather ignores it by taking the rather modern scientific position of starting with the observed data (motion etc) and constructing a theory based on the data as opposed to Parmenides attempts to work from pure logic. Russell also observes that both sides were mistaken in believing that there can be no motion in a plenum, but arguably motion cannot<i>start</i> in a plenum.<sup class="reference" id="cite_ref-7"><a href="http://en.wikipedia.org/wiki/Nothing#cite_note-7" style="color: #727272; text-decoration: none;"><span></span><span></span></a></sup> Cyril Bailey notes that Leucippus is the first to say that a thing (the void) might be real without being a body and points out the irony that this comes from a materialistic atomist. In this scenario, space is not "nothing", but a receptacle in which objects of matter can be placed. This characterisation of space reached its pinnacle with Isaac Newton who asserted the existence of absolute space. Interestingly, modern quantum theory agrees that space is not the void, there is the concept of quantum foam which still exists in the absence of all else, although Albert Einstein's general relativity no longer agrees with Newton's concept of an absolute space. René Descartes, on the other hand, returned to a Parmenides-like argument of denying the existence of space. For Descartes, there was matter, and there was extension of matter leaving no room for the existence of "nothing".<sup class="reference" id="cite_ref-11"><a href="http://en.wikipedia.org/wiki/Nothing#cite_note-11" style="color: #727272; text-decoration: none;"><span></span><span></span></a></sup><br />
The idea that space can actually be empty was generally still not accepted by philosophers who invoked arguments similar to the plenum reasoning. Although Descartes views on this were challenged by Blaise Pascal, he declined to overturn the traditional belief, commonly stated in the form "Nature abhors a vacuum". This remained so until Evangelista Torricelli invented the barometer in 1643 and showed that an empty space appeared if the mercury tube was turned upside down. This phenomenon being known as the Torricelli vacuum and the unit of vacuum pressure, the torr, being named after him. Even Torricelli's teacher, the famous Galileo Galilei had previously been unable to adequately explain the sucking action of a pump.<sup class="reference" id="cite_ref-12"><a href="http://en.wikipedia.org/wiki/Nothing#cite_note-12" style="color: #727272; text-decoration: none;"><span></span><span></span></a></sup><br />

His ideas mostly stem from, or are based on his work of translating pseudo-Dionysius. His beliefs are essentially pantheist and he classifies evil, amongst many other things, into<i>not-being</i>. This is done on the grounds that evil is the opposite of good, a quality of God, but God can have no opposite, since God is everything in the pantheist view of the world. W. F. Hegel</span></span></h4>Georg Wilhelm Friedrich Hegel (1770–1831) is the philosopher who brought the dialectical method to its pinnacle of development. According to Hegel in <i>Science of Logic</i> the dialectical methods consists of three steps. First, a thesis is given, which can be any postulate in logic. Second, the antithesis of the thesis is formed and finally a synthesis incorporating both thesis and antithesis. Hegel believed that no postulate taken by itself can be completely true. Only the whole can be true and the dialectical synthesis was the means by which the whole could be examined in relation to a specific postulate. Truth consists of the whole process, separating out thesis, antithesis or synthesis as a stand-alone statement results in something that is in some way or other untrue. The concept of "nothing" arises in Hegel right at the beginning of his <i>Logic</i>. The whole is called by Hegel the "Absolute" and is to be viewed as something spiritual. In delivering the ruling the judge agreed with the insurance company that the claim was frivolous. The Judge stated nevertheless, that the lawyer held a policy from the company in which it had warranted that the cigars were insurable and also guaranteed that it would insure them against fire, without defining what is considered to be unacceptable fire, and was obligated to pay the claim.<br />

Rather than endure lengthy and costly appeal process, the insurance company accepted the ruling and paid $15,000 to the lawyer for his loss of the rare cigars lost in the "fires."<br />

After the lawyer cashed the check, the insurance company had him arrested on 24 counts of ARSON!!!
